第一条 捐赠事项

1、Donation Amount: Party B voluntarily donates the amount of (Currency) ________ (in words: ______________________), equivalent to approximately RMB ________ (converted at the exchange rate on the date of signing this Agreement).
捐赠金额：乙方自愿无偿捐赠（币种）_____________元（大写：____________________），折合人民币约________________元（按协议签署日汇率计算人民币金额）。

2、Purpose: The funds shall be exclusively used for temple quality improvement projects (e.g., hall renovation, fire safety upgrades, cultural relic preservation, etc.) and shall not be used for non-religious purposes.
用途：资金专项用于寺庙提质改造（如殿堂修缮、消防设施升级、文物保护等提质改造项目），不得用于宗教活动以外的用途。

Article 2: Obligations of Both Parties

第二条 双方义务

甲方承诺：

To strictly use the funds for the agreed purposes, accept supervision from religious authorities and Party B, and provide periodic reports on fund utilization and project progress (e.g., invoices, photos, etc.).


资金严格用于约定用途，接受宗教事务部门及乙方监督，定期提供资金使用报告及项目进展证明（如发票、照片等）。 To comply with Chinese laws and regulations, including the Regulations on Religious Affairs, Law on the Management of Activities of Overseas Non-Governmental Organizations in China, and foreign exchange regulations, and complete necessary approval procedures.
遵守中国法律法规，包括《宗教事务条例》、《中华人民共和国境外非政府组织境内活动管理法》及外汇管理相关规定，办理必要审批手续。 To assist Party B in applying for tax exemption for overseas donations in accordance with the Enterprise Income Tax Law of the People’s Republic of China and the Notice on Issues Concerning Tax Deduction for Public Welfare Donations.
根据《中华人民共和国企业所得税法》《关于公益性捐赠税前扣除有关问题的通知》等规定，协助乙方办理境外捐赠免税手续。 Party B Undertakes:


 

1、The source of funds is lawful, and no political or religious conditions are attached.


资金来源合法，不附加任何政治、宗教条件。

2、To cooperate with Party A in providing documents required for foreign exchange transactions (e.g., fund source declaration, identity verification, etc.)

配合甲方完成外汇入账所需文件（如资金来源声明、身份证明等）。

 

Article 3: Fund Management


第三条 资金管理

1、Party A shall establish a dedicated account for managing the funds and complete foreign exchange settlement procedures in accordance with the law

甲方（受赠方）须开设专项账户管理资金，并依法办理结汇手续。

2、If the project is terminated or surplus funds remain, the use of funds shall be adjusted or refunded through the original remittance channel upon mutual agreement and approval by religious authorities.

如项目终止或资金剩余，经双方协商并经宗教事务部门批准后调整用途或按原汇款渠道退回。

 

Article 4: Governing Law and Dispute Resolution

第四条 法律与争议

This Agreement shall be governed by Chinese law. Any dispute arising from this Agreement shall be submitted to the competent court in the jurisdiction of Party A’s location.

本协议适用中国法律，双方不可撤销地同意，任何争议均提交甲方所在地有管辖权的人民法院管辖。

This Agreement shall take effect only after being filed with local religious authorities and foreign exchange administrative departments.

本协议需经当地宗教事务部门及外汇管理部门备案后方可生效。

 

Article 5: Miscellaneous

第五条 其他

In case of any discrepancy between the Chinese and English versions, the Chinese version shall prevail.

协议中英文版本如有冲突，以中文为准。

This Agreement is prepared in duplicate, with each party holding one copy.

备注：本协议一式两份，甲乙双方各执一份。
